European Union Montreal Protocol Regulation
For refrigeration the regulation sets out the restrictions for the use of recycled and reclaimed HCFCs. There are differences between Regulation 2037/2000 and Regulation 1005/2009.
The new regulation changes the definition of 'placing on the market', which means that HCFCs can only be supplied (whether for sale or by transfer of ownership) in a limited number of circumstances. The restrictions also apply to Virgin HCFCs usage in servicing or maintenance.
There are new rules for recycled and reclaimed HCFCs.
There are new labelling requirements for equipment that is serviced or maintained with recycled or reclaimed HCFCs.
There are new control measures for leakages and emissions and requirements for qualifications for servicing. These are very similar to the requirements for the F-Gas Regulation 842/2006.
Some Member States may have their own regulations that are tighter than the EU Regulation.
